I. CALL TO ORDER
Chairwoman Bishop called the regular meeting of the Princetown Planning Board to order at 7:27 p.m.
II. REVIEW AND APPROVAL
A. Minutes of October 23, 2008 - A motion was made by C. Mathews and seconded by D. Knutti to
approve and file the October 23, 2008 Planning Board minutes with recommended changes.
ROLL CALL: 7-0 MOTION CARRIED
III. CORRESPONDENCE
A. November 3, 2009 memo from P. Bishop to Supervisor Maura, Councilwoman Whitely and CEO
Lenic regarding followup to SUP discussion.
B. November 6, 2008 letter from D. Cole regarding revision of water district boundary to coincide with
McClaine subdivision property boundary.
C. November 10, 2008 letter from D. Cole regarding descriptions and drawings for revised residential
Type II street and revised Standard Commercial street.
IV. PRIVILEGE OF THE FLOOR
There were no comments.

V. PUBLIC HEARING
A. Public hearing is still open for consideration of the application for subdivision submitted by Kenneth Shear for property
located at 713 South Kelly Road. Applicant proposes to create two lots of 5.000 acres and 11.186 acres from tax parcel
46.00-3-1 located at 713 South Kelly Road. Attorneys for the two parties have formally requested an adjournment until
agreement can be reached on the road frontage issue.
Attorneys for the two parties are working the issues out. The Planning Board will hold this Public
Hearing open for an additional month.
B. Brrr Heating
Application of Robert Pahl for renewal of a Special Use Permit to operate a business known as Brrr Heating Oil located
at 1282 Pangburn Road that involves the storage and maintenance of oil trucks.
Terms of previous SUP: No in-ground fuel storage allowed on property; oil spill plan furnished to
Planning Board; oil trucks and service vehicles allowed to be stored and maintained on property;
SUP to be renewed every five years.
Public Hearing opened at 7:37 p.m.
There were no community comments.
Attorney Mathes confirmed that SEQR is not required.
The applicants confirmed to Chairwoman Bishop that they'd provided the Town an "Oil Spill
Contingency Plan" upon issuance of the original SUP.
D. Thorpe asked the applicant for revised contact information for the contingency plan. Applicant
agreed to provide updated contact information for the Oil Spill Contingency Plan.
It was clarified that the property is in a W4 overlay District, not W2, as originally indicated in the
original SUP permit issued in February 2008.
The applicant requested that the Board consider the permit period be longer than five years.
Chairwoman Bishop indicated that a motor vehicle repair facility requires five years as a maximum
period for a SUP, and other periods at the discretion of the Board.
Attorney Sarjeant clarified for the Board and the applicant that the SUP is issued to the applicant,
not the business.
There was question as to the paving schedule. The applicant has complied with the specific
request of the original SUP, having paved the first 1000' of driveway. The question remains as to
when the remainder of the parking lot will be paved. The original Building Permit indicated the
remainder would be eventually paved.
A motion was made by A. Torre and seconded by R. Norkus that the Board approve the SUP for
the applicant: Brrr Heating, LLC - with the following conditions:
- No change in owner or use
- Unlimited timeframe for the permit
- Subject to annual CEO inspection
- Same conditions as previous SUP with the exception of the timeframe

C. Princetown Autobody
Application of Gary Fatato for renewal of a Special Use Permit to operate a motor vehicle repair business known as
Princetown Autobody at 1296 Pangburn Road.
Terms of previous SUP: Body, frame and chassis repairs to be allowed in one existing building
owned by Robert Pahl; hours of operation 7 AM - 6 PM; comply with Section 7.4 of Zoning Code:
Motor Vehicle Repair.
Public Hearing opened at 8:01 p.m.
It was clarified that the applicant is a tenant of Barbob Properties, LLC.
G. Santabarbara will obtain and make copy of property owner's authorization for the file.
The Board and the applicant clarified the nature of the business which is auto body, frame and
chassis repairs.
Chairwoman Bishop asked the applicant if there are any waste tires on the property. The applicant
responded that there are but they don't get built up and are periodically picked up (minimum 50
tires for pickup).
The applicant also indicated he utilizes a waste oil furnace and does not store it, reprocess it or
refine it.
A. Torre suggested the applicant be subject to an annual CEO inspection where special attention
should be paid to excess tires, oil, etc.
A motion was made by T. Edwards and seconded by D. Knutti that the Board approve the SUP
renewal for the applicant: Princetown Auto Body, with authorization from Robert Pahl - with the
following conditions:
- Subject to annual CEO inspection (CEO to pay particular attention to the number of excess
tires and waste oil on site)
- Same conditions as previous SUP
- Five-year duration

VI. OLD BUSINESS
A. Thomas Ketchum diner at 655 Western Turnpike.
Final plans were submitted and signed by Chair. Chair met with Supervisor Maura, Councilwoman
Whiteley and CEO Lenic on Nov. 3 to discuss Ketchum's SUP permit history as it relates to storage
of junk cars, as per concerns of County in their review of diner project.
B. Subdivision application of Carol Maddalla for property located along Rt. 160.
Nothing new received.
C. Major subdivision application of Joseph Lucarelli for property located at 1363 Gifford Church Road.
Nothing new received. Applicant needs to secure variances before proceeding.
D. McClaine major subdivision at 2654 Pangburn Road.
Nothing new received. Applicant needs to secure variances before proceeding.
E. Lands of Richard Muselbeck and Donald Rose, Sr. at 1319 Scotch Church Road
Nothing new received.

VII. NEW BUSINESS
A. Tenant list provided by Robert Pahl for Barbob Properties, 1282 - 1288 Pangburn Road.
James Stekeur, Jr. of TJ Waste Services will be attending meeting.
The Board and the applicant reviewed the tenant list provided to the Planning Board:
TJ's Waste - James Stekeur was present
- P. Bishop expressed concern that W4 overlay does now allow for solid waste
storage
- They are not in the storage or processing business
- SUP will be required along with authorization from Robert Pahl
- Public Hearing will be scheduled for the next meeting - December 11, 2008

It was suggested that the Pahl's contact the Town Planner to ensure a potential tenant runs a
business that is an allowed use within W4 and provide SUP permit application along with lease
agreement.
VIII. ADJOURNMENT
A motion to adjourn the meeting was made by R. Norkus.
